A delinquency petition was filed this week for the former Noblesville West Middle School student who opened fire at his school in 2018.

A new criminal charge filed against him is unrelated to the shooting. He was set to be released when he turned 18.

But a judge ordered he remain in custody after Madison County prosecutors accused him of punching a DOC case manager in the breast at a Pendleton Correctional Facility, where he was staying. The alleged incident happened in March, and he was still 17 at the time.

The probable cause affidavit says the case manager reported she was punched twice, and indicated the punches weren’t very hard. She said they weren’t sexual in nature, but it was inappropriate.

The affidavit says another case manager, Jordan Coty, escorted the inmate to a separation block after the incident was reported to him the same day. He confirmed he did punch the female case manager in the breast, but said it was horseplay.

The former Noblesville student is now 18, and a psychological assessment was set for a judge to review the results. Updates on the psychological assessment have not been released.

The criminal charge for punching the case manager would be a level 6 felony. The initial hearing for the charge and delinquency petition is set for May 23.
